Bicyclist’s family files wrongful death suit

The family of Kristopher Smith, a 19-year-old who was hit and killed while riding his bicycle last year, is seeking $7.5 million in a wrongful death lawsuit. 

Kristopher was hit by Charles Iott, who had a history of medical problems that impaired his driving ability. The lawsuit states Mr. Iott is a “dangerous driver who knowingly endangered the community.” Eight weeks prior to hitting Kristopher, Iott’s eye doctor told him his vision was so poor it was unsafe for him to drive and disqualified him from doing so. The suit claims “Defendant Iott knowingly carried a history of poor vision, diabetic retinopathy, and severe macular degeneration.”

In addition to the tragic accident involving Kristopher, Defendant Iott had received multiple violation citations and speeding tickets. He also rear-ended a family dropping off children at a day-care facility.
