The driver did not see the pedestrian until impact. The roadway had no sidewalks, had insufficient lighting, and was not properly maintained by the city. As a result, the roadway flooded during rain and forced the pedestrian into the roadway, where she was hit head-on and suffered catastrophic injuries.
