McDonald v. City of Port Orchard, Ives, Ludwig, and Prestige Properties

$3.57 million settlement in a defective roadway design case.  A pedestrian was walking at night on a flooded roadway and was struck by an oncoming vehicle.  The driver did not see the pedestrian until impact.  The roadway had no sidewalks, had insufficient lighting, and was not properly maintained by the city.  As a result, the roadway flooded during rain and forced the pedestrian into the roadway, where she was hit head-on and suffered catastrophic injuries.
