Wrongful-death Lawsuit Filed Against Nursing Facility

Nursing home abuse or neglect often results from the failure of a provider or facility to maintain a certain standard of care and quality of life. 

In such a tragic incident, the family of 78 year old Sebastian Lopez has filed suit against the Mesa Verde Post Acute Care Center, arguing that the nursing facility was abusive, negligent, and neglectful in its hiring and supervision. 

Lopez, because of a prior condition, was prone to falling and as such required specialized 24 hour care. The suite alleges that after about two weeks at the care center, Lopez suffered a preventable fall because his bed was so low. Lopez later explained to his wife that because of his fall, a nurse “got mad at him […] threw him back into bed […] and left him in bed to suffer the painful consequences of his fall.” Moreover, the care center did not properly document the incident nor provide Lopez with his requisite medication. 

Due to his fall and the following negligent care, Lopez tragically died the next day. 

The Lopez’s family attorney stated “disregarding this obligation, the facility took the money, accepted the known responsibility for him and then failed miserably to provide Sebastian his required care that needlessly resulted in his death.”
