Patients in Washington state are encountering increasing obstacles when trying to obtain their medical records, with complaints to the Department of Health nearly doubling since 2020.
The Washington Department of Health data highlights the growing scope of the issue, with complaints about access to medical records rising from 59 in 2020 to 112 in 2024.
Despite state law requiring healthcare providers to deliver records within 15 business days, some patients report waiting months or even years for documents they are legally entitled to.
These delays are affecting real people in real ways. Workers are being denied compensation claims, cancer treatments are disrupted, and individuals are suffering financial hardship, job loss, and legal setbacks.
The ripple effects are especially damaging in personal injury claims, where timely access to records is essential. Without them, cases are delayed, settlements are reduced, or claims may even be dismissed altogether.
State Senator Tina Orwall of Des Moines introduced legislation earlier this year to strengthen patient rights and curb excessive fees for accessing records. Although the bill stalled this session, it is expected to be reintroduced next year.
