Prevention of Nursing Home Abuse: WAC 388-97-0640

Placing your family members in a nursing home is challenging and emotional because it means that they need daily care and living assistance. As you reconcile the physical and cognitive changes that come with your family members aging, it can also be challenging to find a nursing home you can trust to provide proper care.

Washington State laws are in place to protect your loved ones in nursing home facilities. Nursing Homes must provide adequate care to their residents under Washington State law and can be held liable if standards are not met. Washington Administrative Code 388-97-0604 calls for specific rules surrounding nursing home abuse.

Abuse in Nursing Homes

Every resident in a nursing home is protected by law from abuse including:

  • Verbal abuse
  • Sexual abuse
  • Physical abuse
  • Mental abuse
  • Corporal punishment
  • Involuntary Seclusion

In addition, nursing homes must have written policies and procedures that work to prevent the abuse of residents. Staff are also required to report abuse and any kind of inappropriate actions towards the residents, including financial exploitation or mishandling of their property.

Reporting Abuse

When nursing homes receive reports of abuse they are required by law to have all the alleged violations investigated, put in place measures to prevent further abuse, and report the incidents to the state within five days of the incident.

If your family member has become a victim of nursing home abuse, or you suspect they might be, it is recommended to speak to an experienced personal injury attorney who can support you in your case.
